Smart Law also means anticipating and managing litigation

Anticipating risks to prevent or to use litigation as leverage, guiding companies and their executives towards alternative modes of dispute resolution to avoid lengthy proceedings, building legal strategies and safeguarding the short- and long-term interests of our clients : that is the expertise of our 20 dedicated litigators team.

Working closely with the other teams of the firm, our litigators support with determination our clients before both national (civil, commercial, criminal and administrative) and arbitral courts, as well as before the regulatory authorities.

Our broad experience in litigation and our knowledge of our clients’ challenges are key to assisting them in anticipating and managing conflicts.

Commercial, consumer and distribution litigation

We work alongside you to defend your business strategy. Our services cover pre-litigation and litigation related to all corporate activities and trade relations, including contract negotiation and performance, distribution of products or services, antitrust issues and unfair competition. We are particularly skilled in  the area of consumer law: unfair terms, product compliance,  including class actions.

Banking and Finance Litigation

Working tightly with the Banking and Finance team, our litigators advise and assist financial intermediaries or banks through litigation involving their civil or criminal liability or between them and their business customers or partners. We also work in the area of disciplinary proceedings before the ACPR or the AMF and assist banks that have fallen victim to fraud or embezzlement.

Our team is also recognised for its experience in enforcement proceedings, particularly with regard to banking issues.

Professional Liability (companies, executives, regulated professions)

We have developed special expertise in the area of professional liability, leading us to manage major serial litigations for our clients in the legal (regulated professions), financial or technical (diagnosticians) fields.

Industrial risks and product liability

Our team is one of the most highly regarded on the market for industrial risks and product liability. We assist our industrial or insurance company clients at all stages of the proceedings, from precautionary measures to court ordered expert proceedings and subsequent steps of litigation. We have expert knowledge of technical and financial issues and proceedings before both judicial and administrative courts.

Business criminal law

Because white collar crime today is a concern that all companies must deal with, we help you to manage criminal risks. At the first sign of possible liability (seizure, judicial confiscation, summons, police report, custody), we step in to prepare and manage all stages of the criminal proceedings, from investigation and taking evidence all the way through the criminal hearings. Upstream, we help you set up internal policies for prevention of criminal risk (training, risk audit, preparation for hearings and custody). We assist you in the exercise of your civil party rights in the criminal and/or civil court when you are the victim of a crime.

Corporate litigation, shareholder disputes

We work alongside with our mergers and acquisitions team on many disputes in the area of corporate law, whether they concern conflicts between shareholders or involving former executives, the implementation of liability guarantees, or post-acquisition litigation.

Arbitration and alternative dispute resolution

Our team has experience with alternative dispute resolution methods (conciliation, mediation, expert opinions) including arbitration (institutional and ad hoc rules). Through our offices around the world, we are able to accompany you in various jurisdictions.

Construction litigation

We have developed unique expertise in overseeing disputes related to public and private construction projects.

We assist contracting authorities and developers before the start of work (preventive measures), during construction (work site incidents, subcontractor claims), after completion (abnormal neighbourhood disturbances, schedule of values, builder’s contractual and legal liability, construction insurance policies).

With this expertise, we can offer comprehensive assistance throughout the entire construction operation.
