Breakfast Talk in Vietnam | Sanctions and export controls: key takeaways

On 29 September, Antoine Logeay had the pleasure of participating in a breakfast discussion organised by CCI France Vietnam – CCIFV, alongside Camille Mayet, with Dr. Rémi Nguyen moderating the discussion.

The session brought together business leaders and experts to discuss the increasingly complex world of sanctions and export controls and what these developments mean for companies operating in Vietnam.

The many questions raised by participants made for a particularly engaging and practical discussion, covering issues ranging from customer screening and checking end-uses to re-exports and technology transfers.

Vietnam’s evolving export-control framework

Vietnam’s export-control rules are evolving, and companies need to consider whether their products, technologies or equipment are subject to local controls and whether specific licences or authorisations are required before exporting or transferring them.

Multiple regulatory regimes can apply

A single transaction may also need to be assessed against several sets of rules. Companies operating in Vietnam may, for example, need to consider EU sanctions, US export controls and Chinese restrictions or countermeasures at the same time.

Compliance with one regime does not necessarily mean that a transaction complies with the others, making it important for businesses to understand the different requirements that may apply to their activities.

Increased scrutiny over potential circumvention

The discussion also addressed the growing scrutiny in Southeast Asia over potential circumvention.

Companies therefore need to carefully check their customers and business partners, understand the final destination and end-use of their products, and maintain clear contractual and documentary records.
