Flash Info Algeria | Supplementary finance law for 2020

The Supplementary Finance Law for 2020 was published in the Official Gazette on 4 June 2020 and represents a major turning point in the country’s foreign investment policy, in contrast to the approach taken ten years ago.

Three key measures are worth noting:

  • The 49/51 share capital distribution rule is repealed with the exception of activities in strategic sectors (listed in Article 51 of the law) and retail activities;
  • The State’s right of pre-emption (direct transfers) and the State’s right of repurchase (indirect transfers) are repealed;
  • External financing in foreign currencies is now permitted.
