
Bernadette Fahy is a senior legal counsel handling Commercial Dispute Resolution
Based in Hanoi, Bernadette Fahy is an experienced lawyer specializing in commercial dispute resolution, with a particular focus on international arbitration cases (UNCITRAL, SIAC, ICC, and VIAC rules), as well as investment law, corporate law, commercial law, and labor law. She has over 30 years of professional experience in Vietnam.
Bernadette qualified as a UK barrister and has extensive experience as a lawyer and in-house counsel in leading international firms including Clifford Chance, ExxonMobil (London), Ernst & Young and Gide, advising on a series of major dispute cases. She has represented clients in bilateral investment treaty disputes and defended the Vietnamese government in a case under the Vietnam- Netherlands Bilateral Investment Treaty.
Her expertise includes construction dispute resolution, particularly for major international engineering and construction companies. She has experience in applications for the enforcement of foreign arbitral awards in Vietnamese courts, following the 1958 New York Convention and Vietnamese Civil Procedure Code.
Bernadette also advises a leading hotel management company on its Vietnamese operations, handling dispute resolution with hotel owners.
She has served as a legal expert for UNDP and UNICEF, contributing to the development and amendment of Vietnamese laws and regulations.
