Adoption by the National Assembly of the bill to simplify economic life & its impact on commercial leases
The bill passed by the National Assembly on June 17, 2025 provides for the generalisation of monthly rent payments, rental guarantees limited to the equivalent of three months’ rent and a ban on the re-invoicing of property tax. The bill is now in the hands of a joint committee composed of members of the National Assembly and the Senate, who are working to reach a compromise acceptable to both chambers. We will therefore have to wait patiently before the final version is decided upon !

URBAN PLANNING
Likely reinstatement of the obligation to install solar panels on outdoor parking lots
On July 3, 2025, as part of its review of the proposed law to simplify urban planning and housing regulations, the joint committee reinstated the requirement to equip outdoor parking lots over 1,500 m² with photovoltaic panel canopies covering at least 35% of half their surface area.
Originally removed by the Senate, this measure has returned in the final version of the urban planning simplification bill, reaffirming the government’s commitment to the energy transition.
The proposed law was debated in a public session on July 9, 2025.

A future legal status for private landlords? a tax reform to watch closely
On June 30, 2025, Senators Daubresse and Cosson submitted a report to Valérie Létard proposing the creation of a tax status for private landlords. The goal: to stimulate rental investment through five key measures starting December 2025 (property depreciation, increased micro-landlord tax allowance, enhanced deduction of property deficits, exemption from real estate wealth tax (IFI), and exemption from capital gains tax). This would be an incentive-based framework, but subject to conditions for long-term rentals. These measures could be included in the 2026 Finance Bill (PLF), to be debated in fall 2025. No legislation has been passed as of yet.
CONSTRUCTION
Publication of decree no. 2025-619 of July 8, 2025, known as “MagicobusII”
Decree no. 2025-619 of July 8, 2025, known as “Magicobus II,” notably clarifies the rules on territorial jurisdiction regarding in futurum investigative measures. When the expert assessment concerns a property, the decree grants exclusive jurisdiction to the court in the district where the property is located (Article 145 of the French Code of Civil Procedure). For example, the Paris Judicial Court may no longer be seized of such a request solely on the grounds that one of the defendants is domiciled in Paris, as previously permitted under Article 42 of the Code of Civil Procedure.
This provision applies to any legal action or notice of appeal filed on or after September 1, 2025.
